Immediate Health Freedom Action Needed
Nationwide
SUPPORT U.S. H.R. 3380 : H.R. 3380, “The Dietary Supplement Protection Act of 2011”, amends the Dietary Supplement Health and Education Act of 1994 (DSHEA), so that DSHEA not only allows and protects for the sale of dietary supplements marketed “before1994”, but in the future it would also allow for sale and protection of all products marketed “before 2007”! Support the DSHEA protection amendment now and protect thousands of safe products currently on the market from FDA’s aggressive attempt to force dietary supplements out of existence via their draft guidance for New Dietary Ingredients! Introduced on Nov. 4, 2011 by Representative Dan Burton [R, IN-5], H.R. 3380 was referred to the House Committee on Energy and Commerce: Subcommittee on Health. What the Bill Does:
H.R. 3380 is a perfect solution to FDA’s hostile document! DSHEA law says that a “dietary supplement” is a supplement marketed “before” 1994, and that a “new dietary ingredient” is a supplement marketed “after” 1994. Of course both dietary supplements and new dietary ingredients must abide by the good manufacturing practices and the adverse event reporting laws. But new dietary ingredients have an added level of regulatory requirements. Now the FDA is trying to say that many of the dietary supplements currently on the market are “new dietary ingredients” and must abide by expansive requirements.
But H.R. 3380 will protect our supplements NOW. And we can also demand Congressional hearings on the misleading and hostile draft guidance! H.R. 3380 simply says, lets amend DSHEA and change the dietary supplement date of 1994, to 2007. This is a common sense solution and will immediatly protect supplements. It will quicklyprotect manufacturers and consumers from the dire threat of FDA’s flawed interpretation of existing law which, if applied, would create a loss of thousands of supplements and huge economic consequences for any manufacturer and consumer of a New Dietary Ingredient (NDI). Because the FDA’s recent Draft Guidance for NDIs reveals an overbroad interpretation of what an NDI is and when an NDI notification is required , H.R. 3380 would immediately put thousands of dietary supplement products out of reach of FDA mandates for NDIs by placing products outside of the definition of an NDI.
H.R. 3380 reminds FDA that any NDI, even if not marketed before 1994, is still a food: an herb, an amino acid, a vitamin, a mineral, or other ingredient defined in DSHEA.
H.R. 3380 supports DSHEA’s clearly stated law that “dietary supplements shall be deemed food”.
H.R. 3380 re-affirms Congress’s intent in DSHEA1994 that Congress NOT “impose regulatory barriers limiting or slowing the flow of safe products … to consumers…” because “dietary supplements are safe within a broad range of intake, and safety problems with the supplements are relatively rare;” and because “nearly all consumers indicate that dietary supplements should not be regulated as drugs … .” Click HERE to read the Bill.

- Contact the members of the U.S. House Subcommittee on Health listed below and spread the word to your friends and family. Let them know you oppose the bill and why they should too! Telephone calls, emails or letters are extremely important at this time! WE CAN DO THIS TOGETHER! A concerted effort will get this accomplished!
Contacting Congress and Spreading the Word.
Contact Congress by phone, e-mail, or personal letter to Support H.R.3380. Build a relationship with them and talk to them about your rights as a consumer to unimpeded access to safe and effective dietary supplements. Also tell them that you depend on a broad range of dietary supplements for preventative and therapeutic nutrition-based self-care for you and your family.
The message : “I support H.R. 3380 as written – it protects consumer access to valuable dietary supplements by amending DSHEA’s grandfathering date forward to 2007, from 1994. It would immediately prevent FDA from imposing on certain products FDA’s onerous reporting requirements for NDIs and avoid the detrimental economic impact of compliance with cost prohibitive requirements.
